The ECJ ruling on the time recording obligation
In May 2019, the European Court of Justice (ECJ) ruled that the recording of working hours in all member states is to become mandatory. The background to the decision is that, in the EU's view, workers' rights cannot be sufficiently enforced. Many companies do not record their employees' times at all or not reliably, which makes enforcement difficult.
In order to be able to monitor minimum rest periods and maximum working hours, time recording is essential. The newly introduced obligation applies equally to all employees. In particular, it does not distinguish according to working time model, meaning that flexible working arrangements such as trust-based working hours are also affected by the time recording obligation.
Legal consequences of the time recording obligation
Until now, German law only stipulates that overtime worked beyond contractually agreed working hours must be documented. As a result of the ECJ ruling, time recording must now begin from "hour zero". To date, the ECJ ruling has not been transposed into national law. Nevertheless, the ruling already has a certain binding effect on labour courts, which has not yet been clearly defined legally.

How did the ECJ ruling on the time recording obligation come about?
It began with a Spanish trade union that took legal action against a subsidiary of Deutsche Bank. The reason was that the employees' hours worked were not being recorded. They had agreed on trust-based working hours. The Spanish Supreme Court then referred this case to the ECJ.
The ECJ ruling on 14 May 2019: EU member states are obliged to introduce a system for recording their employees' working hours. Only with such a system, the ruling states, can the EU Working Time Directive on maximum working hours and rest periods be complied with.
