The ECJ ruling on the time recording obligation

In May 2019, the European Court of Justice (ECJ) ruled that the recording of working hours would become mandatory in all member states, which was implemented in 2023. The background to the decision is that, in the opinion of the EU, employees’ rights cannot be sufficiently enforced. Many companies do not record their employees’ working hours or do not do so reliably, which makes it difficult to take action.

In order to be able to monitor minimum rest periods and maximum working hours, time recording is essential. The newly introduced obligation affects all employees equally. In particular, it does not differentiate between working time models, i.e. flexible forms of work such as trust-based working hours are also affected by the time recording obligation.

Legal consequences of the time recording obligation

Until 2023, German law only stipulated that overtime worked in excess of the contractually agreed working hours must be documented. As a result of the ECJ ruling, time recording must now begin at “hour zero”.

How did the ECJ ruling on the time recording obligation come about?

It started with a Spanish company that sued a subsidiary of Deutsche Bank. The reason for this was that the hours worked by the employees were not recorded. They had agreed on trust hours. The highest court in Spain then referred the case to the ECJ.

The ruling of the ECJ on May 14, 2019: EU member states are obliged to introduce a system for recording the working hours of their employees. Only with such a system can the EU Working Time Directive on maximum working hours and rest periods be complied with.
